Terms & Conditions – SmartOdds

By accessing or subscribing to our services, you agree to be bound by these Terms & Conditions ("we", "us", "our"). Please read them carefully.

1. Membership & Eligibility

  • By accessing or subscribing to our services, you represent that you are at least 18 years of age and fully competent to enter into these Terms. If you are under 18, you are not permitted to use our services.
  • Membership begins once your registration is approved and continues until terminated in accordance with these Terms. We may accept or reject membership at our discretion and may terminate your membership at any time without notice if these Terms are breached.

2. Subscription & Fees

  • You agree to pay the subscription fee ("Subscription Fee") for the plan you select, as displayed on our website or communicated to you at the time of subscription. Subscription Fees are payable monthly in advance.
  • We may increase the Subscription Fee. The new rate will apply from your next billing cycle after we notify you at least 14 days before implementation.
  • Subscriptions auto‑renew unless cancelled before the end of the then‑current term. You authorize us to charge your provided payment method accordingly.

3. Cancellation & Refunds

  • You may cancel at any time via account settings or by contacting info@smartb.com.au. Cancellation takes effect at the end of the current billing period.
  • No Refunds: Subscription Fees are non‑refundable. No partial periods or unused portions will be refunded.
  • Optional Exception: If you upgrade plans mid‑term, we may issue a prorated credit applicable to your upgraded plan.

4. Account Security & Usage

  • You are responsible for maintaining your account username and password confidentiality. You may not share your account. We may terminate accounts in violation of this or if inaccurate, incomplete registration information is provided.

5. Commercial Use & APIs

  • Unless explicitly permitted, our services (including any API or data feeds) are for personal, non‑commercial use only. Any commercial use or resale of our data without prior written consent is prohibited.
  • If you misuse the API (if applicable), we reserve the right to suspend or terminate your access immediately.

6. Content & Third-Party Data

  • SmartOdds may incorporate data from third‑party providers (e.g., Racing Australia). We provide this for informational purposes only and make no warranty regarding its accuracy, timeliness, or reliability.
  • All rights in third‑party content remain with the original rights holders.

7. Changes to Terms

  • We may revise these Terms at any time. Material changes will be communicated by email or posted on our site at least 14 days before taking effect. Continued use after such notification constitutes acceptance of the revised Terms.

8. Limitation of Liability

  • To the fullest extent permitted by law, SmartOdds disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose.
  • We are not liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of services.
  • Our aggregate liability is limited to the total Subscription Fees paid by you during the 12 months preceding the claim.

9. Privacy Policy

  • Your personal information is handled in accordance with our Privacy Policy. By agreeing to these Terms, you also agree to the Privacy Policy.

10. Governing Law

  • These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of laws principles.

11. Intellectual Property

  • All intellectual property in relation to content on this Site belongs to SmartB or its licensors, advertisers or affiliates. You obtain no interest in that intellectual property. All content on this Site is protected by Australian and international copyright and other intellectual property laws. You may not do anything which interferes with or breaches those laws or the intellectual property rights in the content.
